In Texas, what is an “interlocutory appeal”?
Generally, in Texas, an appeal may only be taken from a final judgment. A party may appeal before there is a final judgment only when there is an interlocutory order (i.e., an order which is not a final judgment) which is expressly made appealable by a statute. When there is a statute which expressly permits the appeal of a particular interlocutory order, the appeal of that interlocutory order is called an “interlocutory appeal.” When there is an appeal from an interlocutory order, that appeal is accelerated.
