A motion for extension of the deadline to file a response to a Texas Supreme Court petition for review or to file brief in the Texas Supreme Court must state the existing deadline, the length of the extension being sought, the facts which are the basis for seeking the extension (i.e., why the extension is justified), and the number of previous extensions which have already been granted for the document to be filed. See Texas Rule of Appellate Procedure 10.5(b). The motion must also contain a certificate of conference. See Texas Rule of Appellate Procedure 10.1(a)(5). A filing fee must generally be paid when filing the motion.
