In Texas, the court of appeals sends a letter advising whether there will oral argument in an appeal. This letter will assign three justices to the case. If the court of appeals has only three justices, those three justices will usually be the three justices assigned to the case, although sometimes one of those justices will not be assigned to a case, and a visiting judge will be assigned instead.
