When is a mandate issued after an appeal in Texas?
The clerk of the Texas court of appeals that rendered the appellate judgment generally issues a mandate ten days after the deadline for further Texas state appellate actions. See Texas Rule of Appellate Procedure 18.1. Unless a stay of issuance is granted, the mandate is generally issued irrespective of the date for filing a petition for writ of certiorari in the U.S. Supreme Court. See Texas Rule of Appellate Procedure 18.2.
